1. We respect copyright
AIXNEX takes copyright seriously. We will respond to clear, complete notices of infringement and, in clear cases of repeat infringement, will terminate the accounts of users who repeatedly upload or generate infringing content.
2. How to send a notice
Send a written notice to legal@aixnex.com with the subject line “Copyright takedown notice”. To be valid, the notice must include all of the following:
- An identification of the copyrighted work you say is infringed (or, for multiple works on the same site, a representative list);
- The exact URL or other reasonable identifier of the allegedly infringing material on AIXNEX;
- Your name, postal address, telephone number, and email address;
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law;
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the owner of the right being infringed (or are authorised to act on the owner's behalf);
- Your physical or electronic signature.
3. What we'll do
- Acknowledge your notice in writing, normally within 5 business days;
- Where the notice is complete and the claim is plausible, remove or disable access to the content promptly;
- Notify the user who uploaded or generated the material and forward your notice (with your address redacted on request);
- Keep an internal record of the notice and our action.
4. Counter-notice
If you are the user whose content was removed and you believe the removal was a mistake or misidentification, you may send us a counter-notice at legal@aixnex.com. To be valid, your counter-notice must include:
- Your name, postal address, telephone number, and email address;
- Identification of the material that was removed and where it appeared before removal;
- A statement, made under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
- A statement that you consent to the jurisdiction of the federal courts of the district in which your address is located, or of Dubai, UAE if your address is outside the United States, and that you will accept service of process from the person who sent the original notice or their agent;
- Your physical or electronic signature.
Where the law requires it, we will forward valid counter-notices to the original complainant and may restore the content if they do not file a court action within the statutory window.
5. Repeat-infringer policy
We will terminate accounts that, in our judgement, repeatedly infringe copyright. We may also terminate an account on the first incident if the conduct is egregious.
6. UAE and GCC reporters
For rights-holders relying on UAE Federal Decree-Law No. 38 of 2021 on Copyrights and Neighbouring Rights, the procedure above produces an outcome equivalent to a formal complaint to the UAE Ministry of Economy and is generally faster. You retain the right to escalate to the Ministry or to a court of competent jurisdiction at any time.
7. Misuse
Sending a knowingly false notice is unlawful in most jurisdictions. We may decline to act on, and may publicly disclose, notices we reasonably believe were sent in bad faith.
